Action by the plaintiff Mary Agnes Steffes, as administratrix of the estate of her son, Bernard Matthew Steffes, against the
defendant insurance company to recover damages for the wrongful death of such son, and a separate action by the plaintiff
Emmanuel Joseph Steffes against the defendant insurance company to recover damages for personal injuries sustained in the
same automobile accident that caused the death of Bernard Mutthew Steffes. The two actions were consolidated for purposes
of trial. Bernard and Emmanuel Steffes were brothers and guest passengers in an automobile driven by one James Walsh at the time the
accident occurred. The defendant had issued a policy of automobile liability insurance insuring the Walsh automobile, which
policy was in force and effect at the time of such accident. The actions were tried to the court and a jury. The jury returned
a special verdict wherein it was found that Walsh had been guilty of causal negligence with respect to the management and
control of his car, and that both Bernard and Emmanuel Steffes had assumed the risk of such negligence. Separate judgments
were entered under date of April 1, 1958, dismissing the complaints. From such judgments the plaintiffs have appealed. The
facts will be stated in the opinion.
